SUMMARY
Mr. Phillips, a Principal with Long
International, has over forty years of U.S. and international experience in the
refining and chemical processing industries. His background includes expertise
in construction contract disputes analysis and resolution, project management,
program management of multiple projects, engineering/ construction management,
cost and schedule control, and economic evaluation and risk analysis. His work
history includes 25 years with The Dow Chemical
Company and 10 years with M. W. Kellogg. This experience of working for
both an owner and an engineering contractor firm has given him an understanding
of the contract performance issues involved from both perspectives. He has

Mr. Phillips’ background in engineering and project management has involved the analysis and resolution of contract disputes on various types of projects, both in the U.S. and internationally. Representative experience in claims analysis and resolution includes the following:
Analysis of change orders, delay, loss of productivity, and liquidated damages related to the engineering, procurement and construction of four PET chemical plants in Argentina, The Netherlands, Mexico, and Spain in support of expert testimony in international arbitration.
Analysis of change order and delay claims totalling $85 million submitted by a South Korean EPC contractor on the construction of an offshore production facility being fabricated in Texas and South Korea..
Analysis of cost overruns and schedule delays related to the engineering, procurement and construction of a polyol chemical plant in Tennessee.
Analysis of a major oil company’s claim against a contractor for $29 million in improper charges on a reimbursable contract for the fabrication in Louisiana and Venezuela of one offshore gas compression platform and two wellhead platforms.
Analysis of a Japanese contractor’s $35 million change order, delay, and loss of productivity claims on a LPG FPSO project being constructed in Japan for installation in West Africa.
Analysis of a contractor’s $19 million change order, delay and disruption claim associated with the construction of a MDI Chemical plant in Texas.
Analysis of a major engineering and construction firm’s $25 million claim against an owner relative to cost overruns on a $250 million refinery project in California.

Analysis and mediation testimony in a technical dispute between a major engineering and construction firm and an equipment manufacturer involving critical welding procedures.
Provided overall guidance on contract dispute resolution to owner project teams involved with a $4 billion (approximate) restructuring of a chemical complex in former East Germany. The intent of this oversight was to have a uniform approach to dispute resolution across multiple projects.
Negotiated a settlement of a claim between an engineering and construction firm and a Japanese equipment manufacturer involving faulty manufacturing.
Negotiated a settlement of a claim for extra costs against an engineering and construction firm by a Korean equipment manufacturer.

As a Principal with Long International, Mr. Phillips provides project management, claims analysis and dispute resolution services to the construction industry. He is skilled in the assessment of technical issues and evaluations of project management performance of owners and construction contractors on engineering, procurement, and construction contracts for process plant and industrial projects. He has analyzed engineering, procurement, and construction costs and project documentation to identify responsibility for cost overruns.
The Dow Chemical Company
Houston, Texas, Seadrift, Texas, St. Charles, Louisiana, Bound Brook, New Jersey, Charleston, West Virginia, Texas City, Texas (2001 – 2002)
Coordinated development of inquiry specification for major demolition and environmental cleanup projects at the five Dow (formerly Union Carbide Corp.) sites listed above. Worked with project teams to select demolition contractors and develop claim prevention procedures.
Houston, Texas; Stade, Germany; Leipzig, Germany (1989 - 1998)
Project Engineering leader responsible for coordinating engineering, cost, and schedule management for a $4 billion (approximate) restructuring of a privatized East German chemical complex. The restructuring program, to be accomplished in a 5-year period, consisted of 14 grass-roots production facilities, 7 major revamps, and more than 100 infrastructure and utility projects.
Manager of the Project Controls (estimating, cost control, scheduling) Department in Houston, Texas, consisting of approximately 50 people responsible for schedule and cost control of chemical projects worldwide. In this role, Mr. Phillips led teams to develop corporate procedures for cost estimating, cost and schedule management. He was responsible to review and approve capital cost estimates prior to submittal to Dow’s director of engineering and ultimately to the Dow board of directors for authorization.
Project Engineer for MDI project in Stade, Germany. Mr. Phillips was responsible for coordinating engineering, procurement and construction for a grass roots MDI production unit. The facility had the unique feature of having the complete phosgene handling area (approximately 30% of the plant) contained in a domed steel cylinder capable of containing a fire or explosion.
M. W. Kellogg, Houston, Texas
Houston, Texas (1980 - 1989)
Project Manager for a refinery expansion project involving Hydrotreater, Sulfur Recovery, and Hydrogen Units for Mobil in Torrance, California. This project was the largest refinery project awarded in the U.S. in 1985. Acted as Proposal Manager for preparation of the lump-sum proposal. After contract award, successfully managed the project to earn full client bonus for on-time completion. Mr. Phillips was also the Project Manager on a Catalytic Cracking Unit revamp for Shell in Wood River, Illinois, a Delayed Coking Unit for Tenneco (now Mobil) in Chalmette, Louisiana, a Cumene Project rebuild (fire damage) for Shell in Deer Park, Texas, and various studies, proposals and small projects in United States, Trinidad and Tobago, Taiwan, Colombia, Venezuela and Saudi Arabia.

Houston, Texas; Rotterdam, The Netherlands; Stade, Germany; Toronto, Canada, and Tulsa, Oklahoma (1964 -1980)
Chief Engineer, Dowell Division (Tulsa, Oklahoma). Mr. Phillips managed the engineering department and was responsible for design of mobile (truck-mounted) equipment for oil well treating.
Project Engineering Department Manager (Toronto, Canada). Mr. Phillips managed a department of approximately 20 project engineers responsible for coordination of engineering, procurement and construction for Dow’s Canadian capital expansion program.
Civil Engineering Department Manager (Houston, Texas). Mr. Phillips managed a department of approximately 60 civil engineers, technicians and architects responsible for detailed foundation, structural and architectural design for Dow facilities worldwide.
Plant Engineering Department Manager (Stade, Germany). Mr. Phillips established and managed the plant engineering department responsible for the design of small capital and maintenance facilities.
Project Engineer for glycerin, and propylene oxide/propylene glycol units in Stade, Germany and a styrofoam plant in Norrkoping, Sweden. He was responsible for coordinating the engineering, procurement and construction of these units which were engineered in Dow’s engineering office in Rotterdam, The Netherlands. The glycerin plant was the largest built at that time by the relatively young Rotterdam office. In addition to completing the design for the project, his responsibilities involved training Dutch personnel.
