On behalf of an owner, provided technical support for a claim against the EPC firm on a fast-track refinery project in the western United States. Issues involved late and deficient engineering, design development and scope increases, loss of construction labor productivity, and mismanagement of subcontractors and costs.

As the owner’s representative, provided technical support and status reporting on a fast-track refinery expansion project in the western United States. Work included preparing a FEL-3 cost estimate and schedule, and weekly project controls and reporting of labor hours, productivity factors, costs, changes, delays, and schedule status.

On behalf of an owner, assessed delays to overall mechanical completion, delays to initial acceptance, defective works counterclaims, cost reduction claim, elements of technical design, cost and schedule overruns, and Ready For Start-Up (RFSU)/Commissioning delays. Prepared expert reports, expert reply reports, and joint expert reports for tribunal submission. Provided litigation support, including preparation of cross-examination questions, and testified in arbitration hearings.

On behalf of an engineering design and project management firm of a fuel oil and diesel oil bulk storage tank farm facility, evaluated and rebutted claims by the owner regarding alleged delays, loss of revenue, repair costs, and cost overruns caused by errors and omissions in design and negligence that hampered the safe and profitable operation of the storage facility. Prepared an expert report for submission to the Appeals Circuit at the Commercial Court of Jeddah, Saudi Arabia, rebutting the engineering design and project management firm-caused design errors, omissions, and delays.

On behalf of an EPC contractor, analyzed change order, delay, and loss of productivity claims on a linear alpha olefin project.

An EPC contractor installed a wet type fuel gas desulphurization unit to an existing power facility utilizing combustion turbine scrubbers. The project involved coordination or works around an existing operating plant and a tight site with regard to construction and storage space facilities. Prepared defense for the main contractor from subcontractor and critical vendor supplier claims involving delay and disruption impacts and the application of liquidated damages. The project also suffered from prime contract delays caused by owner interference and local labor regulations and rules instigated by the owner post contract execution that severely impacted the main contractor’s ability to manage the subcontract craft workers. Provided CPM schedule, cost, and change order analyses to support the main contractor’s claims against the owner.
