On behalf of an owner, provided quality assurance reviews of an EPC contractor’s schedules for an LNG facility.
On behalf of an owner, performed a comprehensive audit of issues that caused substantial delay and cost overruns on a multibillion-dollar gas-to-liquids processing plant. Issues included evaluation of the man-hour and cost estimate for the project, labor productivity, effect of design changes, assessment of the EPC contractor’s management performance, and government-caused problems. Delays and cost overruns were tied to issues to allocate responsibility of the parties.
On behalf of an owner seeking to recover hundreds of millions of dollars in delay and disruption costs paid to an EPC contractor on an LNG plant, performed the following scope of work: 1) critique of the contractor’s compliance with industry practices in the preparation and updating of the project baseline CPM schedule and schedule updates; 2) preparation of a windows-based schedule delay analysis to quantify delays on the critical and near-critical paths; 3) assessment of delay, disruption, and project management performance issues by the EPC contractor; and 4) quantification of delay and disruption damages incurred by the subcontractors in the construction of the facility. Prepared an expert report to be submitted as part of arbitration proceedings.
On behalf of an owner, evaluated a piping module subcontractor’s delay claim associated with a GTL facility. Evaluated the integrity of the subcontractor’s schedules and verified the impact of changes to the subcontractor’s schedule. Participated with the EPC contractor and owner to achieve a settlement of the time extension and cost components of the subcontractor’s claim.
On behalf of the government, evaluated the quality of the CPM schedules prepared by several international oil companies for the development of an LNG facility in Tanzania.
On behalf of a contractor, evaluated defective design and project management performance problems associated with an offshore underwater gas extraction facility, offshore pipelines, and an onshore gas processing plant. The contractor was a joint venture of the design firm and the underwater pipeline installation company. Under a lump sum turnkey contract, the contractor was responsible for carrying out project design, engineering, procurement, construction and commissioning. The owner terminated the contractor and sought damages recovery.
On behalf of an owner, participated in the preliminary analysis and evaluations of delay and disruption claims by an EPC contractor on a large LNG project in the southeastern United States. Evaluated multiple EPC contractor delay claim submissions and reports that included calculation of delay costs. The owner used these independent evaluations in pre-mediation discussions and negotiations.
Retained by a major U.S. gas generation and distribution company to review existing plans and procedures for change order management and project cost and schedule control. Suggested modifications/enhancements to those plans and procedures and provided templates for the contents of these plans and procedures. Also prepared proforma EPC contracts for lump sum and reimbursable cost work.
On behalf of an owner, evaluated its claims against an engineering and construction contractor for defects in its installations and late completion of the work. Prepared an expert report, but the case settled before the arbitration hearing.
