Retained by a major U.S. gas generation and distribution company to review existing plans and procedures for change order management and project cost and schedule control. On behalf of an owner, participated in the preliminary analysis and evaluations of delay and disruption claims by an EPC contractor on a large LNG project in the southeastern United States. Evaluated multiple EPC contractor delay claim submissions and reports that included calculation of delay costs. The owner used these independent evaluations in pre-mediation discussions and negotiations.

On behalf of an owner, analyzed schedule delay claims by a prime contractor on an LNG facility being constructed.

On behalf of a major U.S. oil company, evaluated a civil subcontractor’s delay claim regarding foundation and civil works associated with a GTL facility. Evaluated the integrity of the subcontractor’s schedules and verified the impact of changes to the subcontractor’s schedule. Participated with the EPC contractor and owner to achieve a settlement of the time extension and cost components of the subcontractor’s claim.

Performed project management audits of a gas-to-liquids facility to assist with evaluating the outstanding engineering and construction scope, assess restructuring of the project management team, and assist with the development of a Request for Proposal for the selection of a project management contractor.

On behalf of an owner seeking to recover hundreds of millions of dollars in delay and disruption costs paid to an EPC contractor on an LNG plant, performed the following scope of work: 1) critique of the contractor’s compliance with industry practices in the preparation and updating of the project baseline CPM schedule and schedule updates; 2) preparation of a windows-based schedule delay analysis to quantify delays on the critical and near-critical paths; 3) assessment of delay, disruption, and project management performance issues by the EPC contractor; and 4) quantification of delay and disruption damages incurred by the subcontractors in the construction of the facility. Prepared an expert report to be submitted as part of arbitration proceedings.

On behalf of the owner, performed an independent preliminary review and assessment of the contractor’s claims and its entitlement for an extension of time on a central gas processing facilities project. During the review, analyzed relevant project schedules, documents, information, and particulars provided by the owner. Prepared a report evaluating the delay issues alleged by the contractor for use in anticipation of arbitration.

Illinois

Retained by the owner of a natural gas liquids extraction and fractionation plant involved in arbitration with an electrical and instrumentation contractor. Analysis and opinions provided included contract review, determination of breach of contract, delay analysis, and calculation of cost reimbursements owed to the contractor and damages incurred by the owner.

Australia

On behalf of a contractor, evaluated defective design and project management performance problems associated with an offshore underwater gas extraction facility, offshore pipelines, and an onshore gas processing plant. The contractor was a joint venture of the design firm and the underwater pipeline installation company. Under a lump sum turnkey contract, the contractor was responsible for carrying out project design, engineering, procurement, construction and commissioning. The owner terminated the contractor and sought damages recovery.
