Performed damages and schedule analyses for a contractor in a $1.3 million dispute with its earthwork and utilities subcontractor. Submitted an expert report that asserted $300,000 in damages and defended a $1 million counterclaim. Prepared all damages and schedule analyses and provided testimony in both deposition and arbitration. The contractor received a favorable award.

Nigeria

On behalf of an owner, analyzed an EPC contractor’s $43 million claim on behalf of an owner involving hundreds of alleged P&ID changes to the FEED design of a compressor station and pipeline project. Also analyzed resulting delay to the completion of the project, and the technical entitlement to the P&ID changes based on standard industry practice for design development, the owner’s specifications, and the timing of the changes.

On behalf of an owner, performed an assessment of a contractor’s performance and construction productivity, an evaluation of the contractor’s target cost to complete a natural gas pipeline project, and quantification of costs associated with removing and replacing defective pipe.

Utah

On behalf of the public owner and its attorney, provided analysis of material and construction deficiencies that were performed by the construction contractor that replaced a sanitary sewer pipeline in Utah. The contractor was required to design its installation to keep groundwater from intrusion into the pipe after completion of its work, which it failed to do, alleging changed conditions. The owner issued multiple notices of defects to the contractor in a timely manner. The contractor abandoned the project. Work to date has included an expert report and deposition. Testimony not yet scheduled.

Tunisia

Performed an extension of time claim review, schedule delay analysis, and forensic planning analysis for a central processing facility to collect gas received from all the concession well fields to be compressed prior to transport via pipeline to the treatment plant. The gas pipeline was 24" in diameter and 370 km in length with a maximum capacity of 10 million Sm3/day.

On behalf of an owner, evaluated delays to the installation of a natural gas pipeline project caused by weather delays, defective pipe, and poor performance by the pipeline contractor.
